Recovering Compensation After a Hit & Run Accident

Posted By The Stewart Law Firm, PLLC || 13-Feb-2017

While car accidents are often simple to settle if all parties involved are present, hit and run collisions are more complicated since one party flees the scene before the other can obtain their contact information.

If you are the victim of a hit and run accident, it is important to take the following steps:

  • Gather as much information as possible. Write down as much as you can about the hit and run vehicle, such as the make, model, color license plate number, and other distinguishing characteristics. Do not forget to mention the time and place of the accident, as well as the weather and traffic conditions. Any detail about the crash can prove vital toward identifying the phantom driver.
  • Check for witnesses. Obtain the name and contact information of any witnesses to the accident.
  • Take photographs. Using your cellphone camera, take pictures of the accident. If it is possible, take a photo of the hit and run vehicle as it flees the scene.

How to Recover Compensation

If the police or your attorney can track down the phantom driver, you can file a claim against the driver’s auto insurance policy to seek full recovery. If your injuries exceed the driver’s policy limits, you can file a personal injury lawsuit against him or her to recover the excess amount.

On the other hand, if the driver cannot be found – or if the driver did not have automobile insurance – you may be able to file a claim against your own insurance company to recover damages. However, it is only available for those who have uninsured motorist coverage.
